Prenuptial Agreements

Also called a premarital agreement, a prenuptial agreement is a marriage contract entered into prior to the marriage. Within a prenuptial agreement the parties can predict distribution of assets in case of divorce. Prenuptial agreements help to create certainty and prevent expensive divorce proceedings.

A prenuptial agreement might discuss issues during the marriage and issues in the case that the marriage should end. Issues during the marriage include how couples will pay their joint and separate living expenses and the creation of estate planning tools such as wills and trusts. Post marriage issues may include the division of property and assets attained during the marriage, division of the liabilities incurred during the marriage, designation of each person’s separate property as non-marital, spousal support amounts in case of divorce, and life insurance rights.
